The request submitted to the Constitutional Court by the Budapest-Capital Regional Court in order to review the constitutionality of the Debtors' Relief Act is not well-founded, the Minister of Justice states in a letter sent to the top court published on the government's website on Friday.
László Trócsányi addressed the 17-page letter to the president and the chief secretary of the Constitutional Court dated on 10th September.
Last week, the Budapest-Capital Regional Court, acting in the case filed by the Eger és Vidéke Savings Co-operative against the Hungarian state, suspended the procedure and turned to the top court asking for a review and the annulment with retroactive effect concerning the law on foreign currency loan contracts adopted in July.
Several financial institutions have brought lawsuits at court in order to refute the assumption that unilateral changes to foreign currency loan contracts were unfair.
The Ministry of Justice stated in a notice on 5th September – on the same day as the Court asked for constitutional review – that the Ministry considered the Act to be fully in line with the Fundamental Law of Hungary.
