The infringement procedure instituted due to the Stop Soros legislative package is likely to end before the European Court because the Hungarian government continues to insist on not wanting immigration without Parliament’s approval, and the illegal facilitation of migration will also remain a punishable offence, the Parliamentary State Secretary of the Justice Ministry said at his Friday press conference in Esztergom.

On 9 November 2018, on behalf of the Hungarian Government, Minister of Justice László Trócsányi requested the opinion of the Venice Commission regarding the laws on the establishment of the public administration justice system and courts in Hungary. On 4 March 2019, the Venice Commission presented the Minister with its draft opinion, containing several observations and recommendations.

According to the Justice Minister, the separate administrative branch of the judiciary reinforces the protection of the law. László Trócsányi takes the view that the Venice Commission adopted a balanced report on the setting up of independent administrative courts which also appreciates the goals and efforts of the Hungarian government, the newspaper Magyar Nemzet reported.

The Venice Commission has altered its former communication; according to the new position, if Parliament adopts the amendments to the laws concerned, the Council of Europe’s expert body concerned with issues of constitutional law will abandon its criticisms related to the Hungarians laws on administrative courts, Justice Minister László Trócsányi told the Hungarian news agency MTI on Saturday.
